Terms and Conditions for use of Online and Box Office Ticket Sales


In these Terms and Conditions the following words shall have the following meanings:-

“TTAC” means The Tonbridge Theatre & Arts Club registered charity number 227035

“Theatre” means TTAC trading as The Oast Theatre, London Road, Tonbridge, TN10 3AN

“Tickets” means tickets offered for sale by the Theatre for attending Productions in the Theatre’s auditorium

“Member” means a member for the time being of TTAC who by virtue of their membership is entitled to purchase one Discounted Ticket for each Production

“Associate Member” means an individual, firm or company which, by virtue of paying an annual subscription to TTAC, is entitled to receive 10 complimentary Ticket vouchers

“Booking Form” means the page for the booking of Tickets accessed via the Theatre’s website, and, where applicable, the paper form used by those not booking Tickets online

“Season Ticket Holder” means a Member who by payment of a lump sum at the commencement of the Theatre’s season, has the entitlement to one free Ticket for each Production during that season

“Production” means each play performed by Members at the Theatre including

Youth Theatre plays, but excluding The Hoppers Summer Show

“Discounted Ticket” is a Ticket issued to a Member at a discount to the full price fixed by TTAC from time to time

“Contract” means any contract for the purchase of Tickets made between you and the Theatre

2. The Contract

2.1 These terms and conditions govern all Contracts

2.2 Your Contract will be concluded as follows:-

2.2.1 Completion of the Booking Form ( including, for the avoidance of doubt, the provision of your credit or debit card details), or in the case of personal callers at the box office the tender of cash or a cheque for Tickets, shall constitute an offer by you to purchase Tickets subject to these terms and conditions

2.2.2 Confirmation on the Theatre’s online booking screen, or in the case of those using a paper Booking Form and personal callers at the box office the dispatch or handing over of Tickets shall constitute acceptance of your booking, thus concluding a Contract

2.3 You are entirely responsible for entering your details on the Booking Form, or in the case of personal callers for giving such details. You warrant that all such details are true and accurate and, where you are a Member purchasing a Discounted Ticket, or a Season Ticket Holder claiming a free Ticket, that such Discounted Ticket and free Ticket as the case may be is the only one for the Production

2.4 Where you are making a booking on behalf of a party you accept these terms and conditions on behalf of all members of the party and are responsible for all payments due from the party

2.5 The Theatre restricts the number of Tickets for a Production available to book online to ten. Booking in excess of ten Tickets can only be done by telephone or in person subject to availability

2.6 It is your responsibility to check that the details of the Tickets issued to you are accurate. The Theatre cannot accept responsibility for errors in your booking once processed

3. Terms of Booking and Payment

3.1 You can only pay for Tickets purchased online by means of a valid debit/credit card. If you use a paper Booking Form you may pay by a valid debit/credit card or by cheque made payable to TTAC or cash

3.2 You may reserve Tickets by telephoning the box office in which event you must make payment within 24 hours by cash or cheque delivered to the box office. Failing such payment the Tickets may be sold subject to demand

3.3 The four tip-up seats at the rear of the auditorium are for sale for a period of one hour prior to each performance only on a first-come, first-served basis with payment by cheque or in cash. It is not possible to reserve them or to book them online

4. Returned Tickets

4.1 Tickets cannot be exchanged except in the following circumstances and subject to the following conditions:

4.1.1 the exchange is for another performance of the same Production

4.1.2 the exchange gives rise to no monetary detriment to the Theatre

4.1.3 you request the exchange of the Box Office at least 3 days before the date of the performance of the Production for which the tickets were purchased

4.2 Tickets may be returned for resale subject to the following conditions:-

4.2.1 You give prior notice to the box office by telephone or in writing

4.2.2 Credit will only be given if the box office is able to resell the Tickets, such credit being in the form of a voucher/promotion code redeemable for Tickets for a Production in the then current season

4.2.3 If you do not require credit you should notify the box office

4.2.4 If you require cash you should attend in person on the day of the performance and may deal direct with anyone wishing to purchase subject to such resale being at no greater price than you have paid for the Tickets

5. Conditions of Entry

5.1 You may only sit in the seats for which you have Tickets and you are not permitted to sit in any stairway, gangway or aisle. By prior arrangement with the box office there are limited facilities available to accommodate wheelchair users and to reserve a disabled parking space with easy access to the Theatre

5.2 If you arrive late for the start of a performance or after an interval or leave the auditorium during a performance, to avoid disturbing the audience and the performers you will not be allowed access to the auditorium until a suitable point in the performance at the absolute discretion of the Theatre’s Front of House Manager

5.3 The taking of photographs, capturing of images or the use of any recording devices including but not limited to mobile telephones during any performance is strictly prohibited, and all mobile telephones and like communication devices must be switched off in the auditorium

5.4 Smoking is not permitted anywhere in the Theatre save on stage when required by the Production

5.5 The Theatre reserves the right:-

5.5.1 to utilise a seat for which a Ticket has been sold which remains empty immediately prior to curtain-up to accommodate a potential audience member when all the tip-up seats are taken, unless you have warned the box office that you will be late arriving. No credit can be claimed for Tickets which you have been unable to use for whatever reason

5.5.2 to refuse admission to the Theatre or any part thereof

5.5.3 to request any Ticket holder to leave the Theatre or any part thereof and take appropriate action to enforce the right

5.5.4 to alter or vary the performance due to events or circumstances beyond the Theatre’s control

6. Liability of the Theatre

6.1 Subject to 6.3 below the Theatre shall only be liable for direct losses arising as a result of

6.1.1 the breach of these terms and conditions by the Theatre and

6.1.2 any fraudulent statement or negligent act of the Theatre under or in connection with the Contract

6.2 The Theatre’s total liability under 6.1 above shall be limited to the total face value of your Tickets

6.3 Nothing herein shall exclude or limit the liability of the Theatre for death or personal injury caused by the Theatre’s negligence or fraudulent misrepresentation

7. Entire Agreement

It is the intention of the Theatre that all the terms and conditions of the Contract are contained in these terms and conditions and no variation of the Contract will be valid unless set out in writing and signed by you and on behalf of the Theatre

8. Severability

If any part of these terms and conditions is not enforceable this will not affect the enforceability of any other part

9. Governing Law

These terms and conditions and any Contract incorporating them shall be governed by English law

We collect the following information:

- Name, user name, password and membership number

- Contact information, including telephone number and email address

Demographic information, such as address and postcode

- Payment details, such as Credit or Debit Card Number and associated authentication information.        

This information is required to enable the fulfilment of a ticket(s). It allows us to contact you should there be a problem with a ticket sale, or there is a problem with an event, such as it is unavoidably cancelled. Our ticketing system and payment system is hosted by an external party and, therefore, the personal data is shared with the third party as a Data Processor. However, the Payment Card information is not retained after the payment has been successfully taken.


When first registering, should you tick the box 'Please check this box if you wish to receive news, special offers or other information', then your details will be added to our mailing list to update you of forthcoming events. We do not share this information with further third party organisations.
